Mishcon de Reya has conducted a comprehensive review of the policies and has identified two insurers against whom group claims are now being considered. The insurers are Aviva Insurance Limited and QBE (UK) Limited with specific types of insurance policy wordings. The relevant policy wording for Aviva Material Damage & Business Interruption Policy (JELF/Marsh Resilience wording) and the QBE policy wordings are PHOT010419 (Hotel Insurance Policy), PLSC010419 (Leisure Combined), PBCC170619 (Business Combined Insurance Policy), PNML010119 (Nightclub and Late Night Venue Policy), PLOR010419 (Lorica Leisure) and PCCP010419 (Commercial Combined). We are now inviting policyholders with these insurers and specified types of policy wordings to confirm that they remain interested in participating in a funded group claim.
If you registered with HIGA before the cut-off date (6pm on 6 May 2020) and you are not insured by Aviva Insurance Limited or QBE (UK) Limited with the specified policy wordings above, and you have not sent you policy documents to Mishcon de Reya, Mishcon de Reya will no longer be able to conduct a policy review.

Mitigating Your Loss
Businesses need to recover their losses and one of the ways to do this is to claim losses through business interruption insurance policies.

Insurance Claim Denied?
Many insurers are denying coverage for business interruption losses. It is not financially viable for most businesses to bring legal proceedings against individual insurers.

Told No Cover? Check Again
Lawyers have already reviewed many business interruption insurance policies, including for this sector. The initial view is that there may well be cover for a significant number of businesses who have broader policy wordings. When the insurance industry says you do not have coverage for your business interruption losses, they may not be right. It is worth checking again.

Registrants who signed up before 6pm on 6 May 2020 were able to have their business interruption policy reviewed free of charge. The registration process remained open for policyholders to register their interest to be considered as part of any group claim. Mishcon de Reya has completed a comprehensive review of the insurance policies submitted via HIGA.
Mishcon de Reya has identified at this stage two insurers against whom group claims may be brought. Those insurers are Aviva Insurance Limited and QBE (UK) Limited with specific types of insurance policy wordings. Mishcon de Reya has contacted those HIGA registrants which Mishcon de Reya are aware hold these policies and have invited them to participate in the group action. Other policyholders with the relevant insurers and policy types are invited to register below, if you have not already registered with HIGA. The Mishcon de Reya HIGA team will then be in touch to discuss next steps. At this stage, we are in the process of confirming external funding to bring the group claims.
